A North Carolina daycare center was forced to pay $1 million dollars to the family of a child who suffered a severe brain injury as the result of negligence of one of the daycare’s employees.
The employee turned her attention away from the infant for one or two minutes and found the child unresponsive. The daycare staff performed CPR but could not revive the child and paramedics were called. One emergency worker noticed vomit on the child’s mouth and play mat and realized the child’s airway was blocked. Using suction and blows to the child’s back, the paramedics were able to revive the child but not before lack of oxygen left the child with severe brain damage.
The family sued the daycare on the grounds that they were negligent. The daycare and the name of the plaintiffs were kept confidential.
