Call Us 919-240-4054When you are hurt at work the first problem you may face is getting prompt and effective medical treatment for your injury. The second problem is getting paid for your time out of work.
Payment for lost wages when you can’t work should begin 14 days after your job has notice of your injury. North Carolina law requires an employer to pay two-thirds (2/3) of your average pay over the year before the injury. But you won’t be paid for the first seven days until after you are out of work a total of 21 days. Compensation is paid weekly.
In order to get paid, make sure that you give your employer notice of your injury. You can file a Form 18 with the NC Industrial Commission by mail or email and send a copy to your job. If your employer accepts that your injury should be covered by workers’ comp, you should receive a form with the first check that confirms that your compensation has begun.
Receiving your first check could take weeks – you won’t be paid for the first seven days at first, and payment for the next week out of work won’t be considered to be late unless it is mailed 14 days late. But if you do not receive a check or a form within three weeks, your claim could be denied. Contact your employer or the insurance company to ask why you have not been paid.
